Terms of service
Version 2 of 26 October 2026
These terms are the agreement between you and Kykie when you use the Kykie app. We’ve written them to be read. If anything isn’t clear, ask us at hello@kykie.co.za before you pay.
1. Who we are
Kykie is run by Jasson Mangaliso, a sole proprietor, from Virginia Avenue, Vredehoek, Cape Town, South Africa (“Kykie”, “we”, “us”). You can reach us at hello@kykie.co.za, and about personal information at privacy@kykie.co.za. Kykie isn’t a member of any industry or self-regulatory body.
“You” means the person who signs up, and the studio or business you set up in Kykie. If you sign up for a business, you confirm that you’re allowed to agree to these terms for it.
These terms go together with the acceptable use policy (the rules for outreach) and the privacy notice.
2. What Kykie does, and what it doesn’t
Kykie:
- finds businesses that are publicly listed, for example on Google Maps, in the United Kingdom, Ireland, the United States and South Africa, in the niches and towns you choose;
- checks whether each one fits what you sell, and looks for a business email address on the business’s own website;
- builds proof before you pitch: a draft website, an SEO audit or a Google reviews audit;
- tells you when the business opens a proof, and how: for how long, how far down, what they tapped, on what kind of device and roughly where;
- drafts short notes for you to send from your own mailbox;
- if you connect your mailbox, sends the notes you schedule from it, in each business’s working hours and within daily limits, puts a copy in your Sent folder, and files the answers so you can reply from Kykie.
Kykie never emails businesses on its own account: every note goes from your mailbox, under your name. To find answers it reads only the headers of new mail in your inbox and keeps only answers to notes sent from Kykie; the privacy notice says exactly what it reads and keeps. You can disconnect your mailbox at any time.
Kykie can’t promise that anyone will reply, hire you or pay you: a proof earns attention, and what happens next is between you and the business.
Kykie uses AI (Anthropic’s Claude) to check businesses, build proofs and write drafts, and AI gets things wrong. Read every note and look at every proof before you send it.
Kykie builds each country’s rules into its checks and drafts. They’re our reading of the law, not legal advice for your own outreach. If you’re unsure whether you may contact a business, ask a lawyer.
3. Your account
- You must be 18 or older, and use Kykie for your work as a freelancer, sole trader, studio or company.
- Keep your sign-in details to yourself. You’re responsible for what’s done in your account, so tell us straight away if you think someone else has used it.
- Give true details about your studio, especially the name, email address and postal address that go on your notes. Kykie asks for a postal address before you can contact businesses in the US or the UK.
- During early access Kykie opens to a few studios at a time, by invite. Founding members use an early version: some things will change and some will break. We’ll tell you about changes that affect you.
4. Tokens
Searches, checks, proofs and notes use tokens. The cost of each step is shown before you start it, and the current costs are on the Tokens page in the app. Look alerts, sending from your own mailbox and filing its replies are free.
- Prepaid. Tokens come from your plan, from a top-up, or from us, for example with a founding invite. You pay before you use them.
- Charged only when it works. A step that fails costs nothing. Some finished steps are free too: a search that finds no new businesses, or a check that shows a business doesn’t fit what you sell.
- Held while working. While a step waits or runs, its tokens are held for it. You can cancel a step that hasn’t started.
- No overage. At zero, steps stop. Nothing is ever billed on top of what you’ve paid.
- A daily limit. Each studio can start only so much work in a day, which protects you from runaway use. The limit is on the Tokens page and resets at midnight, South African time.
- For your studio. Tokens can only be used in Kykie. You can’t sell them or move them to another studio.
We may change what steps cost. We’ll email you at least 30 days before a step costs more, and the cost shown when you start a step is what you pay for it.
5. Plans and paying
- Test drive: R99, once per studio, for 14 days. If you stay on a monthly plan after it, the R99 is credited to your first month.
- Monthly plans: Starter, Pro and Studio, each paid one month at a time.
- Top-ups: extra tokens for studios on a monthly plan.
Prices are on kykie.co.za and, once you’ve joined, on the Tokens page. They’re in rand and they’re the full price: nothing is added at checkout.
Plans are month-to-month passes. Kykie doesn’t store your card, so nothing renews by itself: each month is paid on its own, and stopping is simply not paying for the next one. A plan runs for 30 days from the day you pay (the test drive for 14). If you pay for a plan before your current one ends, the new month starts that day and its tokens are added to the ones you have.
Payments go through Paystack, by card or another way Paystack offers. Your card details go straight to Paystack; Kykie never sees or stores them. Your tokens are added as soon as Paystack confirms the payment, usually within a minute.
Unused tokens
- Tokens from a monthly plan that you haven’t used by the end of its month stay for one more month, whether or not you renew. After that, any still unused expire.
- Test-drive tokens last for the 14 days of the test drive. If you take a monthly plan before then, the ones you haven’t used carry on with your plan.
- Top-up tokens never expire while your plan is active.
- Tokens we give you, for example with a founding invite, follow the same rules as plan tokens, and can’t be exchanged for money.
Where a law gives you longer to use what you’ve paid for, that law applies.
6. Changing your mind, refunds and problems
- Cooling-off. You may cancel a test drive, plan or top-up within 7 days of paying for it. If you haven’t used any tokens since you paid, we refund the whole payment within 30 days. Email hello@kykie.co.za. This is your right under section 44 of the Electronic Communications and Transactions Act. Once you start using the tokens, you’ve asked us to start the service, so the cooling-off right no longer covers that payment (section 42(2)(d) of the same Act).
- Something we charged for doesn’t work. If a check or proof you were charged for isn’t what we said it would be, for example a broken draft website or an audit with figures that are clearly wrong, tell us within 30 days. We’ll fix it, redo it or give the tokens back.
- Otherwise we don’t refund payments for tokens you’ve used, or the unused part of a month when you stop. Your unused tokens stay usable as section 5 says.
Nothing in these terms takes away rights you have under the Consumer Protection Act or the Electronic Communications and Transactions Act.
7. Your outreach is yours
You decide which businesses to contact and what to say, and each note goes from your own mailbox, under your own name, whether you send it yourself or Kykie sends it from your connected mailbox when you schedule it. That makes you the sender, responsible for every message under the law of the country where the business is.
- When you connect a mailbox, you confirm it’s yours (or that you may use it), and you keep to your email provider’s own rules and daily limits. Kykie keeps to a daily limit below the provider’s, but a provider can still pause a mailbox it thinks is sending too much.
- Follow the acceptable use policy. It sets out the rules for each country that Kykie builds in, and what’s never allowed.
- Kykie’s checks and drafts follow those rules, but they can’t catch everything. Check before you send.
- Keep the opt-out link Kykie puts in your notes, and honour every opt-out and every “no”, however it reaches you. When a business opts out with the link, Kykie stops you contacting it through Kykie.
8. Proofs
A proof is a draft website, an SEO audit or a Google reviews audit that Kykie makes for one business, so you can show it to them. Each has its own private link, which search engines are asked not to list.
- A proof is a draft. Every draft website carries a line saying it was made for the business by your studio and isn’t their live website. Don’t remove that line, and don’t present a draft as the business’s real site.
- Proofs can show the business’s own name, logo, photos and public details, so they can picture the result. That’s only for showing that business. Don’t use them anywhere else.
- Draft websites stay up for 30 days. You can keep one up longer, 30 days at a time, for a few tokens.
- We take a proof down if its business asks us to, or if it breaks the acceptable use policy.
- If the business hires you, you may use its proof as the starting point for the real work. We give you the right to use, change and hand over the proofs made for your studio, for the business each was made for.
9. Information about businesses
Kykie collects public information about businesses, from their listings, their own websites and public registers, to find and check them for you. The privacy notice explains what we collect, how long we keep it, and how a business can see it or opt out.
When Kykie drafts notes, builds proofs and records looks for your outreach, it handles that business’s information on your behalf. We:
- use it only to run Kykie for you, never sell it, and never show it to other studios;
- keep it confidential and protect it with the measures in the privacy notice;
- tell you without delay if a security breach affects it;
- delete it when you close your account, unless the law says we must keep it.
In return, you use what Kykie shows you only for your own outreach to those businesses. Don’t copy it out of Kykie in bulk, and don’t sell or share it.
10. Your work and ours
- What you put into Kykie (your studio’s details, your notes and your changes) stays yours. You let us use it only to run Kykie for you.
- Kykie itself (the app, its design, its code, its templates and its writing) belongs to us. Don’t copy it, resell it, or try to get around its limits or its security.
- We may use figures from across Kykie, such as how often proofs get looked at by niche and country, to improve Kykie and give tips, but only in a form that never identifies you or a business.
- If you send us ideas or feedback, we may use them without owing you anything.
11. Keeping Kykie running
We work to keep Kykie available and correct, but we can’t promise it will always be up, fast or free of mistakes. It relies on other services (hosting, the database, AI and data providers) that can fail. We may change, add or remove features. If a change takes away something you’ve already paid for, we’ll tell you first and, if you’d like, refund the unused part of your most recent payment.
12. What we’re responsible for
Please read this section carefully: it limits what Kykie is responsible for.
- Kykie doesn’t guarantee results: replies, meetings, clients or income.
- We aren’t responsible for the messages you send, or for what a business, a person or a regulator does about them.
- We aren’t liable for indirect or consequential losses, such as lost profit or lost business.
- Our total liability to you for anything to do with Kykie is limited to what you paid us in the 12 months before the claim.
None of this limits our liability for gross negligence or fraud, or anything else the law doesn’t let us limit, and it doesn’t take away your rights under the Consumer Protection Act.
13. If your outreach leads to a claim
If a business, a person or a regulator makes a claim against Kykie because of a message you sent, or because you broke these terms or the acceptable use policy, you’ll cover Kykie’s reasonable costs of dealing with it, as far as the law allows.
14. Pausing or closing an account
- You can stop using Kykie whenever you like. To close your account, email hello@kykie.co.za from the address you signed up with.
- We may stop steps, take proofs down, or suspend or close your account if you break these terms or the acceptable use policy, if a complaint about your outreach needs looking into, or if the law requires it. Where we can, we’ll tell you why first and give you a chance to put it right.
- If we close your account because you seriously or repeatedly broke the acceptable use policy, we don’t refund unused tokens, as far as the law allows. If we close it for any other reason, or stop running Kykie, we’ll give you at least 30 days’ notice where we can and refund the unused part of your most recent payment.
- When an account closes, we delete its information as the privacy notice describes.
15. Changes to these terms
When we change these terms, the version and date at the top change. If a change matters to you, for example to prices, refunds or what you’re responsible for, we’ll email you at least 30 days before it applies. If you don’t agree, you can stop before then, and we’ll refund the unused part of your most recent payment.
16. Disagreements and the law
If something goes wrong, tell us first at hello@kykie.co.za. We’ll reply within five working days and try to put it right. If we can’t, you can take it to the Consumer Goods and Services Ombud (cgso.org.za), the National Consumer Commission (thencc.org.za) or a South African court. These terms are governed by South African law.
